Terms of Service

Welcome to Moss Calendar. These Terms of Service ("Terms") govern your access to and use of the services provided by Moss Labs Co., Ltd. ("Moss Labs," "we," "us," or "our"), including our mobile application, website located at https://mosslabs.kr, and all related features, content, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. About the Service

Moss Calendar is an event discovery and calendar platform that aggregates publicly available cultural event information — including but not limited to live performances, exhibitions, club events, pop-up markets, and festivals — and presents them in a unified calendar format. The Service enables users to discover events, create and curate personal event calendars, follow other users' curated calendars, and share event information.

Unless explicitly identified as a Moss Labs event, all events displayed on the Service are organized by independent third-party event organizers and venues. For such third-party events, Moss Labs acts solely as an information platform that helps users discover and organize event information. All responsibility for the content, safety, legality, and operation of third-party events rests solely with the respective event organizers and venues. From time to time, Moss Labs may organize or co-organize events listed on the Service; such events will be clearly identified as Moss Labs events.

The Service is operated by Moss Labs from the Republic of Korea. If you access or use the Service from outside of the Republic of Korea, you do so at your own initiative and are solely responsible for compliance with any applicable local laws. The Service may not be appropriate or available for use in all jurisdictions, and Moss Labs makes no representations that the Service is appropriate or compliant with the laws of any jurisdiction other than the Republic of Korea.

2. Eligibility

You must be at least fourteen (14) years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement. Users under the age of fourteen (14) are prohibited from using the Service.

Certain events displayed on the Service may have their own age restrictions, entry requirements, or other conditions imposed by event organizers or applicable law (including, without limitation, age restrictions related to venues that serve alcohol under the Youth Protection Act (청소년보호법) of the Republic of Korea). You are solely responsible for verifying your eligibility to attend any event you discover through the Service. Moss Labs does not verify, enforce, or assume responsibility for event-specific age restrictions or entry requirements.

3. Account Registration

3.1 Creating an Account

To access certain features of the Service, you must create an account. Account registration is available through Apple Sign-In and Google OAuth. You agree to provide accurate and current information during the registration process.

Access to the Service may be limited to users who have received an invitation from Moss Labs or from existing users. Moss Labs reserves the right to limit the number of accounts and to manage access to the Service at its sole discretion, including by requiring invitation codes or other access credentials for account registration.

3.2 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must notify us immediately at contact@mosslabs.kr if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from unauthorized access to your account.

3.3 One Account Per User

You may maintain only one account on the Service. Creating multiple accounts, or creating a new account after your previous account has been suspended or terminated, is prohibited.

4. Content and Intellectual Property

4.1 Moss Labs Intellectual Property

The Service, including its design, features, functionality, software, text, graphics, logos, and trademarks, is owned by or licensed to Moss Labs and is protected by applicable intellectual property laws, including the Copyright Act (저작권법) and the Trademark Act (상표법) of the Republic of Korea. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

4.2 Third-Party Event Content

Event information displayed on the Service — including but not limited to event poster images, promotional descriptions, artist names, venue details, and related materials — is sourced from publicly available third-party content, including social media platforms.

All such content remains the intellectual property of the original content creator or rights holder. Neither Moss Labs nor the user who submitted the event link acquires any ownership rights over third-party event content by virtue of its display on the Service. Moss Labs displays such content solely for the purpose of providing event information to users, in a manner consistent with the provisions for information location tools under Article 102 of the Copyright Act (저작권법 제102조) of the Republic of Korea.

4.3 User-Submitted Content

When you submit content to the Service — such as by pasting a link to create an event listing, creating or naming a calendar board, or adding profile information ("User Content") — you retain ownership of any original content you create. However, you grant Moss Labs a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating, improving, and providing the Service.

By submitting a link or content to create an event listing, you represent that:

(a) You are sharing publicly available information for event discovery purposes;

(b) You do not claim ownership of any third-party content (including images, text, or other media) associated with the linked source;

(c) You believe in good faith that the event information you are submitting is accurate.

4.4 Content Removal Requests (Takedown Procedure)

Moss Labs respects the intellectual property rights of third parties. In accordance with Article 103 of the Copyright Act (저작권법 제103조) of the Republic of Korea, if you are the original creator or authorized rights holder of content displayed on the Service and wish to request its removal, please submit a request to contact@mosslabs.kr with the following information:

(a) Identification of the copyrighted work or content you believe has been infringed;

(b) Identification of the content on the Service that you wish to have removed, with sufficient detail to allow us to locate it;

(c) Your contact information (name, email address, and, if available, phone number);

(d) A statement that you have a good faith belief that the use of the content is not authorized by the rights holder, its agent, or the law;

(e) A statement that the information in your notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder.

Upon receipt of a valid takedown request, Moss Labs will review the request and, where appropriate, remove or disable access to the content without undue delay. We will notify the user who submitted the content of the takedown action where practicable. If you believe content was removed in error, you may submit a counter-notice to contact@mosslabs.kr with the basis for your claim.

Moss Labs may suspend or terminate the accounts of users who repeatedly infringe or are repeatedly the subject of valid takedown requests.

4.5 Proactive Opt-Out for Content Creators

If you are an event organizer, venue operator, or content creator and do not wish for your publicly available event information to appear on the Service, you may request a proactive opt-out by contacting us at contact@mosslabs.kr. Upon receipt of a valid opt-out request, we will add your account or content source to our exclusion list and take reasonable steps to prevent your content from being displayed on the Service going forward.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not, and shall not permit any third party to:

(a) Use the Service for any purpose that is illegal or prohibited by these Terms or by the laws of the Republic of Korea;

(b) Submit false, misleading, or fraudulent event information;

(c) Impersonate any person or entity, or falsely represent your affiliation with any person or entity;

(d) Use any automated means, including bots, scrapers, crawlers, or similar tools, to access or collect data from the Service without our prior written consent;

(e) Interfere with, disrupt, or attempt to compromise the security or integrity of the Service, including introducing viruses, malware, or other harmful code;

(f) Harass, threaten, abuse, or intimidate other users of the Service;

(g) Use the Service to distribute spam, unsolicited messages, or commercial advertisements;

(h) Attempt to circumvent any security features, access controls, or usage limitations of the Service, including invitation or access controls;

(i) Reproduce, distribute, or publicly display any content from the Service except as expressly permitted by these Terms;

(j) Use the Service in any manner that could damage, disable, overburden, or impair the functioning of the Service.

6. Account Suspension and Termination

6.1 Suspension and Termination by Moss Labs

We reserve the right to suspend, restrict, or terminate your account and access to the Service, in whole or in part, at our sole discretion, with or without prior notice, for any reason, including but not limited to:

(a) Violation of these Terms or any applicable law;

(b) Conduct that we reasonably determine is harmful to the Service, other users, or third parties;

(c) Repeated submission of false or inaccurate event information;

(d) Use of automated tools or bots in connection with the Service;

(e) Engaging in spam, harassment, or abusive behavior;

(f) Impersonation or misrepresentation of identity;

(g) Activity that we reasonably believe constitutes fraud or poses a security risk;

(h) Failure to comply with requests from Moss Labs regarding account verification or compliance matters;

(i) Being the subject of repeated valid content takedown requests;

(j) Sharing, transferring, or misusing invitation codes or access credentials;

(k) Any other conduct that Moss Labs determines, in its sole discretion, to be detrimental to the Service or its community of users.

We are not obligated to provide advance notice or an explanation for any suspension or termination, although we may do so at our discretion. Upon termination of your account, your right to use the Service will immediately cease, and we may delete your User Content and account data in accordance with our Privacy Policy.

6.2 Termination by You

You may terminate your account at any time by contacting us at contact@mosslabs.kr or by using the account deletion feature within the Service, if available. Upon termination, your User Content may be deleted in accordance with our Privacy Policy.

6.3 Effect of Termination

Upon termination, any licenses granted to you under these Terms will immediately terminate. Moss Labs shall not be liable to you or any third party for any suspension or termination of your account or access to the Service.

6.4 Survival

Sections 4 (Content and Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law and Dispute Resolution) shall survive any termination of these Terms.

7. Disclaimers

7.1 Service Provided "As Is"

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE REPUBLIC OF KOREA, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Third-Party Events

Unless an event is explicitly identified as a Moss Labs event, Moss Labs does not organize, host, sponsor, endorse, or verify events displayed on the Service. We do not guarantee the accuracy, completeness, or reliability of any third-party event information, including but not limited to event dates, times, locations, pricing, availability, or descriptions. Third-party event information may be sourced from publicly available content and may be subject to change without notice.

7.3 No Responsibility for Third-Party Event Experiences

Moss Labs is not responsible for your experience at any third-party event you discover through the Service. This includes, without limitation, event cancellations, changes to event details, quality of the event, safety conditions at the venue, interactions with event organizers or other attendees, or any injury, loss, or damage that may occur in connection with your attendance at a third-party event.

7.4 Moss Labs Events

From time to time, Moss Labs may organize or co-organize events listed on the Service ("Moss Labs Events"). Such events will be clearly identified on the Service. For Moss Labs Events, Moss Labs assumes responsibility as the event organizer, and the third-party event disclaimers in Sections 7.2 and 7.3 do not apply. Moss Labs Events may be subject to additional terms communicated at the time of the event.

7.5 Age-Restricted Events and Venues

Some events displayed on the Service may take place at venues that serve alcohol or have other age restrictions imposed by event organizers or applicable law, including the Youth Protection Act (청소년보호법) of the Republic of Korea. Moss Labs does not classify, label, or verify age restrictions for individual events. You are solely responsible for determining whether you meet the eligibility requirements for any event.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE REPUBLIC OF KOREA, MOSS LABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE REPUBLIC OF KOREA, THE TOTAL AGGREGATE LIABILITY OF MOSS LABS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO MOSS LABS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED THOUSAND KOREAN WON (₩100,000), WHICHEVER IS GREATER.

THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY ARISING FROM MOSS LABS' GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR TO ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER THE LAWS OF THE REPUBLIC OF KOREA, INCLUDING MANDATORY CONSUMER PROTECTION PROVISIONS.

9. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Moss Labs, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your User Content.

10. Modifications to the Service and Terms

10.1 Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time, with or without notice. This includes the right to modify, expand, or restrict access features such as invitation requirements. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

10.2 Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where practicable, by providing notice through the Service or via email. Material changes will take effect seven (7) days after posting, unless otherwise specified. Your continued use of the Service after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.

11.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the competent court of the Republic of Korea, as determined in accordance with the Civil Procedure Act (민사소송법) of the Republic of Korea.

11.3 Consumer Rights

Nothing in these Terms is intended to limit any rights you may have under the Consumer Basic Act (소비자기본법), the Act on Consumer Protection in Electronic Commerce (전자상거래 등에서의 소비자보호에 관한 법률), or other applicable consumer protection laws of the Republic of Korea. In the event of any conflict between these Terms and mandatory consumer protection provisions, the mandatory provisions shall prevail.

12. Content Monitoring

Moss Labs is not obligated to monitor, pre-screen, or review User Content or third-party event content displayed on the Service. However, we reserve the right (but not the obligation) to review, edit, or remove any content that we determine, in our sole discretion, violates these Terms, infringes on intellectual property rights, or is otherwise objectionable. Your use of the Service constitutes your acknowledgment that we may exercise this right.

13. Push Notifications

The Service may send push notifications to your device to inform you about new events, calendar updates, or other Service-related information. You may manage your notification preferences through your device settings or within the Service at any time.

14. Third-Party Services

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Moss Labs. We are not responsible for the content, privacy practices, or availability of any third-party services. Your interactions with third-party services are governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party services you access through the Service.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moss Labs with respect to the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable by a competent court of the Republic of Korea, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

15.3 Waiver

The failure of Moss Labs to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Moss Labs may assign or transfer these Terms, in whole or in part, without your consent.

15.5 Force Majeure

Moss Labs shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, government actions, or failures of third-party services or infrastructure.

15.6 Language

These Terms are provided in English. In the event that a Korean-language version of these Terms is made available, and there is any conflict or discrepancy between the English and Korean versions, the Korean version shall prevail to the extent required by the laws of the Republic of Korea.
